EMINENT DOMAIN – Brook Lane


WELLS SANITARY DISTRICT


There will be a public hearing to discuss the intent of the Wells Sanitary District (WSD) to take by eminent domain an easement in Brook Lane, Wells, Maine, for the purpose of constructing, establishing, maintaining, and operating sewers and appurtenances thereto.  Said permanent sewer easement limits to be defined as 15' from either side of the proposed Brook Lane Sewer center line, beginning at the intersection with the Sanford Road ROW and extending 15' beyond the SMH-3-401.  There is also a 10’ – 20’ wide temporary construction easement as shown on “Plan of Brook Lane Easement Acquired by Wells Sanitary District, Town of Wells, County of York, State of Maine”, dated 4/26/21 by Wright-Pierce Engineers, Inc., attached hereto as “Exhibit A”.  The amount offered for the land to be taken, based on the fair value as estimated by WSD is One ($1.00) and 00/100 Dollar.


The owners known to be affected are: Glenn C. Fossa, Steven W. and Donna D’Antilio, DL Whistman, LTD.


The Board of Trustees intend to take final action to proceed with the proposed Brook Lane sewer extension after said Public Hearing at the regular monthly Trustees meeting, all in accordance with 38 M.R.S. § 1163.

EMINENT DOMAIN – Wilson Avenue


WELLS SANITARY DISTRICT


There will be a public hearing to discuss the intent of the Wells Sanitary District (WSD) to take by eminent domain an easement in Wilson Avenue, Wells, Maine, for the purpose of constructing, establishing, maintaining and operating sewers and appurtenances thereto.  Said easement to begin at the North sideline of Eldridge Road, at the approximate centerline of Wilson Avenue, so called; thence running northeasterly along the approximate centerline of Wilson Avenue, thirty (30) feet wide throughout, and having a baseline length of seven hundred fifty feet (750’), more or less.  Said easement is shown on “Plan of Wilson Avenue Easement Acquired by Wells Sanitary District, Town of Wells, County of York, State of Maine”, dated 2/27/2020 by Wright-Pierce Engineers, Inc., attached hereto as “Exhibit A”.  The amount offered for the land to be taken, based on the fair value as estimated by WSD is One ($1.00) and 00/100 Dollar.

Dufour, III and Nadica Galapcheva, Richard G. and Kathleen Boone and George A. Boone, Jr., David A. and Patricia A. Decker, Scott Simpson, Randy O. and Suzanne L. Howe, Anthony J. Perrotta, Trustee of the A.J. Perrotta Trust, Donald P. Rogers, Trustee and Jeanne M. Rogers, Trustee of the Rogers Family Revocable Trust of 1998, Philip K. Pearson, Howard R. Goldstein and Anne E. The Board of Trustees intend to take final action to proceed with the proposed Wilson Avenue sewer extension after said Public Hearing at the regular monthly Trustees meeting, all in accordance with 38 M.R.S. § 1163.
